Subletting a shared ownership home – important changes
If you sublet a shared ownership property, you take on the role of a landlord and must comply with all regulations introduced under the Renters’ Rights Act 2025.Some shared owners currently have permission to rent out part or all of their home.
If you sublet a shared ownership property, you take on the role of a landlord and must comply with all regulations that apply to private rentals. From 1 May 2026, this means adhering to the tenancy changes introduced under the Renters’ Rights Act 2025.
If you sublet your home without valid authorisation, you will be in breach of the terms of your lease.
Why is this changing?
From 1 May 2026, the Renters’ Rights Act 2025 introduces new rules for private renting. These rules also apply to subletting shared ownership homes:
- Fixed-term tenancies will end and become rolling (open-ended) tenancies.
- Landlords will no longer be able to use Section 21 (‘no fault’) evictions.
- Tenancies can only be ended using specific legal grounds (Section 8), with evidence if needed.
If you previously had permission to sublet, it was based on using a fixed-term tenancy. Any agreement to sub-let must follow the new rules from 1st May 2026.
Can I still sublet my home?
Yes, but you must apply for permission under the updated rules.
You can usually rent out (sublet) a room in your home, if you continue to live there.
You cannot rent out your entire home unless:
- You own 100% of the property, or
- You have permission from your landlord.
Permission to sublet the whole home is usually only given in exceptional circumstances

When would permission be granted?
We will only consider requests to rent out your entire home in exceptional circumstances.
To be eligible, you must be temporarily unable to live in your home. This may include situations where you:
- Need to relocate for caring responsibilities.
- Need to move elsewhere for work.
- Are a serving member of the Armed Forces posted away from your home area for a fixed period.
We may also consider requests:
- From the estate of a shared owner who has passed away.
- Where the property cannot be sold due to building-related issues, such as cladding or major works.
Each request is assessed on a case-by-case basis.
What happens if I do not apply?
If you rent your shared ownership home sublet without new permission, you will be in breach of your lease.
